ARTWORK ORIGINALITY

(A) All artwork must be original and submitted in the medium in which it was initially created (e.g., paint on canvas, watercolor, etc.). Reproductions of original artwork are ineligible.

  • The artwork must not be an exact replica of, or very similar in appearance to any existing art or other work created by someone else—such as a photograph, painting, drawing, sketch or advertisement, and must not infringe upon anyone else’s copyright or other property or ownership rights.
  • The Sponsors rely in good faith on the entrants’ express representations as to the origins of the art submitted to this program; the Sponsors make no representations about the authenticity or originality of that art.
  • If the Sponsors determine, in their sole discretion, that any of these rules have been violated, the entry may be disqualified and other steps they deem appropriate may be taken.

 

USE OF PERSONAL INFORMATION

By entering a Submission, you consent to the collection, use and disclosure of your personal information by the Sponsors for the purposes of administering the Lilly Oncology on Canvas Canada program including contacting selected entrants, and otherwise in accordance with Lilly’s Privacy Statement or as permitted or required by law. The Sponsors may contact you for more information about your Submission. At that time, you may be offered the opportunity to participate in media interviews concerning Lilly Oncology on Canvas Canada and can accept or decline this opportunity.

If your artwork is a photograph of or shows the recognizable likeness of any person(s), by submitting the artwork, you warrant that any such person(s) (or his/her parent or legal guardian, if the person is under the age of majority), has given permission for this creative work to be entered and used as described in the Official Rules and Regulations.

Please note that if your Submission includes recognizable or abstract facial images, or otherwise reveals personal information, it will be utilized, stored and transported in the same manner as any non-identifiable Submissions.

Unless otherwise agreed to by the entrant, all correspondence between entrants and the Sponsors, including personal information, will be deleted or destroyed upon completion of this program and any exhibits or tours relating to the Lilly Oncology on Canvas Canada program.

 

OTHER TERMS AND CONDITIONS

Transfer of Ownership and Rights

By entering a Submission, you assign to Lilly full ownership of and all rights, including but not limited to all copyright and other intellectual property rights, to your Submission, including but not limited to the right to use, reproduce, display or publish all or any portion of the art and text in any medium (e.g., online, print, television, mobile application, social media, electronic displays at medical or advocacy meetings, or any other public forum, etc.); collateral materials (including, but not limited to media materials, brochures, educational books, postcards, websites, etc.); exhibits; and/or any other manner as determined by Lilly.  You also waive any attribution, integrity, or moral rights in your Submission in favour of Lilly.

Submissions may be incorporated into a travelling exhibition, touring various locations such as cancer centres, hospitals, and patient advocacy groups across Canada.  Your Submission may also be displayed at media events, televised, and/or showcased on the Internet, in print, and other types of media designated by the Sponsors.  Some Submissions may be featured on the Lilly Oncology On Canvas Canada website (www.LillyOCC.com) and/or on Lilly’s social media sites, including but not limited to its Pinterest board (pinterest.com/lillyocc) and Twitter page (https://twitter.com/lillyocc).  Content that is shared through social media sites will remain the property of Lilly and any use of those sites will be subject to any terms of use applicable to these sites.

In addition, Lilly may transfer ownership of the artwork or portions thereof, either original or copies, to the Canadian Association of Psychosocial Oncology (“CAPO”), the Canadian Cancer Survivor Network (“CCSN”) or other non-profit cancer-related advocacy groups or charitable organizations for use in their fundraising efforts or for other appropriate purposes, without any payment to you or any financial benefit to Lilly.

Release

By entering a Submission, you agree to release and hold harmless the Sponsors, their parents, affiliated and related companies, subsidiaries, divisions, advertising and promotional agencies, and each of their respective shareholders, directors, officers, employees, agents, dealers, representatives, successors and assigns (collectively, the “Releasees”) from and against any and all claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action that relates in any way to the Submission. If requested, you must be able to provide to the Sponsors (in a form acceptable to the Sponsors) evidence of compliance with these Official Rules and Regulations, including required permissions and/or intellectual property agreements, in order to be eligible for the Lilly Oncology on Canvas Canada program.

General

All decisions of the Sponsors are final, binding and conclusive in all matters relating to this program. You agree to accept and follow these Official Rules and Regulations and will be deemed to have received and understood them if you participate in the program. All Submissions remain the property of the Sponsors and will not be returned. The Sponsors reserve the right to cancel, withdraw, terminate, modify, amend, extend or suspend the program, or any part of it, for any reason and without notice, including if, in the opinion of the Sponsors, in their sole discretion, the program is not capable of running as originally planned or if the administration, security, fairness, integrity or the proper conduct of the program is corrupted or adversely affected, including by reason of tampering, unauthorized intervention, fraud, technical failures or any other causes beyond their control. The Sponsors reserve the right to disqualify any individual they find to be tampering with the operation of the program or to be acting in violation of the Official Rules and Regulations or otherwise in a disruptive manner.

The program and the Official Rules and Regulations will be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
